For more information about how prosecutors should approach the prosecution of rape and sexual offences, including the application of the Code for Crown Prosecutors, please see our Rape and Sexual Offences Legal Guidance. Where injuries are sustained through assault but do not cause serious injury, this may constitute the offence of assault occasioning actual bodily harm (ABH). Determining whether an injury should be deemed severe or not is often a case of a subjective review. This will usually be the discretion of the prosecutors or an investigating police officer, although legal guidelines and tests provide a basis for this assessment. What injuries are deemed as ABH?

Common assault is now available as an alternative verdict under section 6(3) of the Criminal Law Act 1967, by virtue of section 6(3A) of that Act (which was inserted by section 11 of the Domestic Violence, Crime and Victims Act 2004). This application is usually direct, for example, the defendant punches the victim, thus the defendant himself physically applies the force to the victim’s body. However, this does not need to be the case and force can also be applied indirectly.

The Code further explains that "mere words do not amount to an assault. But the words which a person uses may give to their gestures or preparation such a meaning as may make those gestures or preparations amount to an assault". Assault is in Indian criminal law an attempt to use criminal force (with criminal force being described in s.350). The attempt itself has been made an offence in India, as in other states. Common Assault is a common law offence and is not set out under any statue but charged under s.39 Criminal Justice Act 1988. In day to day speak it is used to refer to the individual offences of both assault and battery.

Usually the doctor or nurse will take the samples, such as swabs from anywhere you have been kissed, touched or had anything inserted. They might also take urine and blood samples and occasionally hair, depending on the information you provide about the assault, and also retain some clothing and other items (if they do they will give you new clothes). Possible examples of defenses, mitigating circumstances, or failures of proof that may be raised in response to an assault charge include: In English law, s.58 Children Act 2004 limits the availability of the lawful correction defense to common assault. [33] This defence was abolished in Wales in 2022. If you want the crime to be investigated, the sooner a forensic medical examination takes place, the better.causing stupor, unconsciousness or physical injury by intentionally administering a drug or controlled substance without consent [71] R v Constanza [1997] Crim LR 576 states that words alone can cause the victim to apprehend harm and thus constitute an assault. For example, “I’m going to hit you” does not need to be accompanied by any action for an assault to occur. The ruling in R v Ireland [1997] 3 WLR 534 takes this further and states that silence can amount an assault. In this case the defendant made a series of silent phone calls to his victim causing them to fear immediate force and leading them to suffer severe psychological damage as a result of his on-going calls. Therefore, both elements of the offence are established and Josh will be liable for the battery on Tim.

In some SARCs you can choose to have your samples processed without identifying you (in case the person who assaulted you has assaulted someone else). Sexual assault referral centres (SARCs) offer medical, practical and emotional support to anyone who has been raped, sexually assaulted or abused. SARCs have specially trained doctors, nurses and support workers to care for you.It is evident from the scenarios above that none of these involve a serious infliction of harm and are limited to situations that would, in absence of consent, realistically be charged as a common assault. Consent becomes a more contentious issue in situations where more serious harm is caused as the law places limits to the level of harm an individual is entitled to consent to.
